Terms of Service

Last updated October 28, 2026

Draft: this text is waiting for legal review and may change before Product Aura takes payments. Questions: [email protected].

In short: Product Aura turns your product photo into marketplace and ad images using AI. You must own or have permission for everything you upload, and you must check every image before you publish it, because AI can get details, text and claims wrong. You pay with credits, and if an image fails to generate we give the credits back automatically.

1. Who we are and what these terms cover

Product Aura (productaura.co) is run by [COMPANY NAME], a company registered in [COUNTRY OF REGISTRATION] under company number [COMPANY NUMBER], with its registered address at [REGISTERED ADDRESS] (“Product Aura”, “we”, “us”). [OWNER: confirm the selling entity, for example PRENUERSTUBE LTD, with the accountant (08 C2 question 7).]

These terms apply when you visit productaura.co, create an account, or use Product Aura in any way, including through our API, our MCP server or our command-line tool (together, the “service”). By creating an account or using the service you agree to these terms. If you use Product Aura for a company, you confirm that you may accept these terms for that company, and “you” means both you and the company.

These pages are part of these terms:

You must be at least 18 years old to use Product Aura. [LAWYER: confirm the minimum age, and whether the service should be offered to businesses only or also to consumers. These terms are written so they work for both.]

2. What Product Aura does

You upload a photo of a product. We read the photo to build a short product profile that you can edit, and then use AI image models to create a set of images for marketplaces and ads, such as Amazon listing images, Amazon A+ content, Etsy and Shopify images and social ads. You can edit or re-generate images and download them, for example as a ZIP file sized for each platform.

We use AI models from outside providers to do this work (see the subprocessor list in the Privacy Policy). We may change which models we use, add or remove features, and change how the service works, as long as the change does not take away something you have already paid for without a fair remedy.

3. Your account

  • You can sign up with an email address or with Google. Give us accurate details and keep them up to date.
  • Keep your sign-in details safe. You are responsible for what happens in your account, unless it happens because of our failure.
  • Tell us straight away at [email protected] if you think someone else has access to your account.
  • New accounts get free credits (see section 5). To stop abuse, we only give free credits to a few new accounts per network per day. We may close accounts that were created to collect free credits, and remove those credits.

Buying credits before you have an account

You can buy a credit pack with a card before signing up. We then create an account for the e-mail address you give at checkout, add the credits to it and show you an API key once. If that e-mail already has an account, the credits go to that account and no new key is made. When the owner of the e-mail first signs in, keys made at checkout are paused until they switch them back on in Settings, because the payment page cannot check who owns an e-mail address. These accounts follow the same terms as any other account.

4. API, MCP server and command-line tool

You can use Product Aura through our public API, through our MCP server (which lets AI assistants such as Claude and ChatGPT use Product Aura for you, after you sign in and approve them), and through our command-line tool (the npm package productaura). They all spend credits from the same balance as the website, at the same prices.

  • API keys are created in Settings and shown only once. Keep them secret, like a password. Anything done with your API key counts as done by you, and the credits it spends come from your balance.
  • An AI assistant you connect can spend your credits within the permissions you approve. You can disconnect it at any time in Settings. You are responsible for what you ask the assistant to do and for checking its work.
  • If a key leaks, revoke it in Settings and tell us at [email protected].
  • We apply rate limits to keep the service fair and stable. Do not try to get around them. The full rules are in the Acceptable Use Policy.

5. Credits

What a credit is

Credits are how you pay for images. One credit is one image at 2K resolution. A 4K image costs 2 credits, and some premium models cost 2 credits per image. Editing or re-generating an image costs the same as making a new one. The cost is shown before you start, and the current price list is on the Billing page.

Credits are a prepaid right to use Product Aura. They are not money. They have no cash value, cannot be exchanged for cash, cannot be transferred to another account and can only be used on Product Aura. [ACCOUNTANT: confirm credits fall outside the e-money rules and how VAT applies to them (08 C2 questions 1 and 2).]

Kinds of credits

  • Free credits: new accounts get 20 free credits, with no card needed. [OWNER: decide whether free credits expire, for example after [X] days.]
  • Plan credits: a subscription adds a set number of credits to your balance each billing period.
  • Bought credits: credit packs you buy once, separate from a subscription. [OWNER: confirm whether packs can be bought by every account or only by subscribers.]

Expiry and spending order

[OWNER: choose one. (A) Plan credits expire at the end of the billing period in which they were added; bought credits do not expire. (B) Unused plan credits roll over while your subscription is active and expire [X] days after it ends; bought credits do not expire. Until you decide, credits are granted without expiry (08 C1). ACCOUNTANT/LAWYER: confirm that expiry is allowed and what notice is needed (08 C2 question 4).]

When you spend credits, we use the ones that expire first. [OWNER: confirm the spending order: free, then plan, then bought.] If we ever introduce or change expiry, we will tell you by email at least [OWNER: 30] days before it affects credits you already have.

Failed images

If an image fails to generate, the credits for that image go back to your balance automatically. You can see every charge and refund in your credit history on the Billing page.

6. Subscriptions and payments

  • Payments are processed by Stripe. We do not see or store your full card number. Prices, plans and credit packs are shown on the Billing page before you pay. Plans can be paid monthly or yearly.
  • Subscriptions renew automatically at the end of each billing period, and we charge the payment method on file, until you cancel.
  • You can cancel at any time in the Stripe billing portal, which you open from the Billing page. Cancelling stops the next renewal. Your plan stays active until the end of the period you already paid for. [OWNER: say what happens to unused plan credits after the plan ends, in line with the expiry choice in section 5.]
  • If we change the price of your plan, we will tell you at least [OWNER: 30] days before the new price applies to you, and you can cancel before then.
  • Prices include or exclude taxes as shown at checkout. [ACCOUNTANT: confirm how VAT and sales tax are charged and shown, and whether Stripe Tax is used.]
  • If a renewal payment fails, Stripe may retry it, and we may hold back new plan credits until it goes through.

7. Refunds, the right to cancel and chargebacks

The full rules are in the Refund and Credits Policy. In summary:

  • If you live in the EU or the UK, you normally have 14 days to cancel a purchase of digital content or a digital service. Product Aura starts working as soon as you generate images. At checkout we ask you to agree that we can start straight away, and to confirm that you lose the right to cancel for credits you have already used. Credits you have not used are covered by the refund rules in the Refund and Credits Policy. [OWNER: this checkout checkbox is planned but not built yet. It must be live before we take payments from EU or UK customers.]
  • If you open a chargeback or payment dispute, we may remove the disputed credits from your balance (even if this makes the balance negative) and pause your account until the dispute is settled. If the dispute is decided in our favour, we add the credits back. If it is decided in your favour, the credits stay removed. Please contact us first at [email protected]. We can usually fix a problem faster than a bank can. [LAWYER: confirm we may claw back credits and suspend the account (08 C2 question 6).]

8. What you upload

“Your content” means the photos, logos, text, product details and other material you upload or type into Product Aura, including the product profile and any instructions you give.

When you upload or enter content, you confirm that:

  • you own it, or you have every right and permission needed to use it in this way, including the rights to every photo, logo, trademark, label, packaging design and product shown;
  • any real person shown in it has agreed to their image being used to make marketing images, and you can show that consent if asked;
  • using it with Product Aura does not break any law, any contract you are bound by or anyone else’s rights; and
  • it follows the Acceptable Use Policy.

You keep all rights in your content. You give us a worldwide, non-exclusive, royalty-free licence to store, copy, process, change and display your content only so that we can run the service for you. This includes sending it to the AI providers and other subprocessors listed in the Privacy Policy, and keeping backups. The licence ends when your content is deleted from our systems, apart from copies in backups, which are deleted on our normal backup cycle.

We do not use your photos or images to train AI models, and we do not sell them. Where an AI provider offers a setting that stops it from training on or keeping your data, we turn that setting on. The providers process your content under their own API terms. [LAWYER: confirm each provider’s current API data terms.]

We will not show your content or images in our marketing without your permission. [OWNER: confirm. If you want to show customer images as examples, ask each customer first.]

9. The images you create

Who owns them

As between you and us, the images you create with Product Aura (“outputs”) belong to you, to the extent the law allows anyone to own them. We give you any rights we may have in the outputs, and you may use them for any lawful purpose, including commercial use. In some countries AI-generated images may not be protected by copyright at all, so others may be free to copy them. [LAWYER: confirm this wording and check the AI providers’ terms on output ownership.]

AI models can produce similar images for different users. We cannot promise that your outputs are unique, and other users may own similar outputs.

AI can make mistakes

Outputs are made by AI and can contain mistakes. The product may look different from the real one, and text, numbers, sizes, ingredients, features, logos or claims may be wrong or made up. You must check every image before you publish or use it.

You are responsible for how you use outputs, including:

  • making sure each image shows your real product accurately;
  • every claim shown on an image, for example health or medical claims on supplements, “best seller” or award badges, certifications, “eco” or “organic” claims, and comparisons with other products;
  • following advertising and consumer-protection law, and any rules for your product category; and
  • following the rules of each marketplace and platform where you use the images.

No warranty about third-party rights

We take care to avoid it, but we cannot promise that outputs are free of third-party rights, such as trademarks, copyright, design rights or a person’s likeness. If an output looks like someone else’s brand, product, artwork or a real person, do not use it.

10. Marketplaces and platforms

  • Product Aura is not made by, endorsed by or affiliated with Amazon, Etsy, Shopify, Meta, TikTok, Google or any other marketplace or platform. Their names are trademarks of their owners and are used only to describe what our images are for.
  • We do not promise that a marketplace will accept your images or listing, or that your sales, rankings or ad results will improve. Marketplace rules change often, and each marketplace decides for itself.
  • Amazon and AI-generated people. An account setting, on by default, adds a short note to your Amazon downloads that explains how to label images with photorealistic AI-generated people the way Amazon asks. If you turn this setting off, you are responsible for labelling those images correctly.
  • Etsy. Etsy downloads include your original, unedited photo as a separate file, because Etsy asks sellers to show what the real item looks like. You are responsible for following Etsy’s rules on how listing photos are made and shown.

11. AI labels in your images

Every image we create carries machine-readable information that says it was made with AI. We use the industry standard IPTC “digital source type” field in the image’s XMP metadata: “trainedAlgorithmicMedia” for images made by AI, and “compositeWithTrainedAlgorithmicMedia” for the white-background main image, which combines your real product photo with AI-made parts.

We do this partly because of the transparency duties for AI-generated content in Article 50 of the EU AI Act. Some laws and platforms may also require you to tell people that an image was made or changed with AI. Do not remove these labels where the law or a platform requires them. [LAWYER: confirm the current scope and start dates of Article 50, and whether any visible label is needed in addition to the metadata.]

12. Acceptable use and takedown notices

You must follow the Acceptable Use Policy. In short: no counterfeits, no other brands’ logos or trademarks without permission, no real people without their consent, no deceptive or illegal products or claims, and no sexual content.

If you think content made or stored with Product Aura infringes your rights or breaks the law, email [email protected]. The Acceptable Use Policy lists what to include. We review every notice, may remove content or suspend accounts, and tell the account holder when it is fair and lawful to do so, so they can respond.

13. Suspending or closing accounts

You can stop using Product Aura at any time. To delete your account and its data, email [email protected] from the email address on the account. Cancel any subscription first, on the Billing page.

We may suspend or close your account, remove content or stop an API key or connected assistant if:

  • you break these terms or the Acceptable Use Policy;
  • we need to in order to follow the law or a request from an authority;
  • your use puts the service, other users or us at risk, for example through fraud or a security threat; or
  • the account was made to collect free credits or to get around a suspension.

Where it is fair and lawful, we will tell you first and give you a chance to fix the problem. If we close your account because you broke these terms, unused credits are lost. If we close it for any other reason, or stop offering Product Aura, we will give you notice and refund unused bought credits and the unused part of a prepaid plan. [LAWYER: confirm.]

When an account is closed, you can no longer download your images, so download anything you want to keep. [OWNER: decide whether closed accounts get a download window, for example [X] days.]

14. Availability

We work to keep Product Aura running well, but we do not promise it will always be available, fast or free of errors. We may pause it for maintenance or upgrades. The AI providers we use can have outages, change their models, or refuse some requests under their own safety rules. We are not responsible for delays or failures caused by events outside our reasonable control.

15. Disclaimers

Apart from what these terms say, and to the extent the law allows, Product Aura is provided “as is” and “as available”, without other promises of any kind, including promises that it will suit a particular purpose. Nothing in these terms limits rights you have as a consumer that the law says cannot be limited.

16. Your responsibility to us (indemnity)

If someone makes a claim against us because of content you uploaded, how you used outputs, or your breach of these terms or the law, you will cover our reasonable losses and costs from that claim, including reasonable legal fees. We will tell you about the claim promptly and let you take part in how it is handled. [LAWYER: confirm whether this should apply to consumers or only to business users.]

17. Limits on our liability

  • Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
  • We are not liable for indirect or consequential losses, or for lost profits, sales, revenue, business, goodwill or data, including losses from a listing being rejected or removed by a marketplace.
  • Our total liability to you for everything connected with Product Aura is capped at the amount you paid us in the 12 months before the event that caused the claim. [LAWYER: confirm the cap, and whether a minimum amount such as [X] should apply for users who paid nothing.]

If you are a consumer in the EU or the UK, we are responsible for loss you suffer that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. [LAWYER: check this paragraph against the consumer rules of the countries we sell to.]

18. Privacy and data processing

The Privacy Policy explains how we handle personal data. If you are a business and your uploads contain personal data of other people (for example a model in a product photo), we process it on your behalf. A data processing agreement (DPA) for business customers is available on request at [email protected]. [OWNER/LAWYER: prepare the DPA.]

19. Feedback

If you rate an image, write feedback or send us ideas, we may use that feedback to improve Product Aura without paying you or owing you anything. Ratings are stored with the model, pack version and prompt that made the image, as described in the Privacy Policy.

20. Changes to these terms

We may update these terms, for example when we add features or when the law changes. We will show the date of the latest version at the top of this page. For important changes we will email you at least [OWNER: 30] days before they take effect. If you keep using Product Aura after that, the new terms apply. If you do not agree, you can cancel and close your account before the change takes effect.

21. Law and disputes

These terms are governed by [GOVERNING LAW], and the courts of [COURTS] can hear disputes about them. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts. [LAWYER: confirm governing law, courts and any consumer dispute-resolution information we must show.]

Before going to court, please email [email protected]. Most problems can be solved quickly that way.

22. Other legal points

  • These terms, together with the pages they link to, are the whole agreement between you and us about Product Aura.
  • If a court finds part of these terms invalid, the rest still applies.
  • If we do not enforce a right straight away, we can still enforce it later.
  • You may not transfer your account or your rights under these terms without our written permission. We may transfer our rights and duties to another company, for example if Product Aura is sold, as long as your rights are not reduced.
  • These terms are written in English. If we provide a translation and the two differ, the English version applies, unless the law where you live says otherwise.

23. Contact

For anything about these terms, your account, billing, privacy or takedown notices, email [email protected]. Post: [COMPANY NAME], [REGISTERED ADDRESS].
